Under the 10th Schedule of Indian constitution, the decision on question as to disqualification on ground of defection is referred to the Chairman or the Speaker of such House, and his decision is final. The law applies to both Parliament and state assemblies. So, the Chairman or the Speaker of the House is the final arbiter in cases of disqualification on grounds of defection. No court has any jurisdiction in respect of any matter connected with the disqualification of a member of a House under this Schedule.
